This installment of “Ask Nick” with Fortune Title Agency President Nicholas Timpanaro deals with whether financing for solar panels should be included as part of a title report. We thought this may be a topic of interest, so we wanted to share Nick’s answer with you.

Question: Our title report reflects a financing statement for solar panels. Since they do not affect the marketability of title, are we able to omit it?

Nick’s Answer: No. Although it does not affect marketability, the UCC (Unified Commercial Code) for the solar panels is something all parties need to be aware of, and it must remain as an exception to the policy. Because the solar panels are now a fixture to the house, the buyer needs to know that if at any time the company supplying them were to come and remove the panels, none of those costs will be covered by the policy.
